Terms & Conditions

These Terms & Conditions explain the rules governing purchases, deliveries and the use of STRAUMHOME services. We encourage you to read them carefully before placing an order.

Important information

By purchasing products from STRAUMHOME, you enter into a contract subject to these Terms & Conditions. Nothing in these Terms is intended to restrict mandatory consumer rights available to you under applicable law.

General

These Terms & Conditions apply to purchases of products offered through the STRAUMHOME online store and to your use of our website.

References to “STRAUMHOME”, “we”, “us” or “our” refer to the legal entity operating the STRAUMHOME online store. References to “you” or “customer” refer to the person purchasing products or using the website.

By submitting an order, you confirm that the information you provide is accurate and that you have legal capacity to enter into the purchase agreement.

Products & Product Information

We take reasonable care to ensure that product descriptions, dimensions, materials, specifications and images displayed on our website are accurate.

Furniture is produced using a variety of materials, and natural variations can occur in wood grain, stone, fabric texture, colour, pattern and finish. These characteristics may make each piece subtly individual and do not necessarily constitute a defect.

Colours may also appear slightly different depending on lighting, photography and your screen settings.

Dimensions are provided to help you determine whether the product is suitable for your space. Please review all measurements carefully before ordering.

Prices, Taxes & Promotions

The price applicable to your purchase is the price shown during checkout when your order is submitted.

Applicable taxes, delivery charges and other mandatory charges, where applicable, will be shown to you before you complete your purchase.

We make reasonable efforts to ensure pricing is accurate. If an obvious pricing, technical or typographical error occurs, we may contact you before processing the order and offer you the option to purchase at the correct price or cancel the order.

Promotional offers

Promotional codes, sale prices and special offers may be subject to specific conditions, validity periods, product exclusions and availability. Unless expressly stated otherwise, promotions cannot be combined.

Orders & Contract Formation

Products displayed on our website constitute an invitation to place an order and do not by themselves constitute our acceptance of an order.

After placing an order, you will normally receive an electronic confirmation summarising the products ordered and the delivery information supplied by you.

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

  • a product is unavailable;
  • payment cannot be authorised;
  • incorrect customer or delivery information has been supplied;
  • an obvious pricing or technical error has occurred; or
  • fraudulent or unauthorised activity is reasonably suspected.

Where an order is cancelled after payment has been collected, the relevant payment will be refunded in accordance with applicable law.

Payment

Available payment methods are displayed during checkout and may vary according to your location or order value.

You confirm that you are authorised to use the payment method submitted with your order and that all billing information provided is complete and accurate.

Payment services may be provided by independent payment processors. Their own terms and privacy policies may also apply to the processing of your payment information.

Shipping & Delivery

Available delivery methods, costs and estimated delivery periods are displayed on our website or during checkout.

Any delivery date or delivery period communicated to you is an estimate unless expressly confirmed as a binding delivery date. Circumstances outside our reasonable control may occasionally affect delivery.

Where tracking is available, tracking information may be sent after your order has been dispatched.

Please ensure your shipping address, telephone number and other delivery details are correct before submitting your order. Incorrect or incomplete information may cause delays.

Furniture Delivery & Access

Before ordering large furniture, you are responsible for checking that the product can reasonably pass through entrances, hallways, staircases, lifts and other access points at the delivery address.

Please compare packaged and product dimensions with the available access space wherever dimensions are provided.

Unless a specific installation or assembly service has been purchased or expressly included, delivery does not automatically include assembly, removal of existing furniture or structural alterations to your property.

Inspection Upon Delivery

We recommend inspecting the packaging and product as soon as reasonably possible after delivery.

If you notice visible damage, missing pieces or an incorrect product, please contact our customer service team promptly and provide:

  • your order number;
  • a description of the issue;
  • clear photographs of the product;
  • photographs of the packaging where relevant; and
  • any other information reasonably required to investigate the issue.

Reporting delivery damage promptly helps us investigate the issue with the delivery provider. This does not remove or reduce any mandatory statutory rights you may have.

Consumer Right of Withdrawal

If you are a consumer purchasing online and applicable law grants you a statutory right of withdrawal, you may generally withdraw from the contract within 14 days without giving a reason.

For goods, the withdrawal period generally begins when you, or a third party designated by you other than the carrier, receives the goods.

To exercise your right of withdrawal, you must send us a clear statement informing us of your decision before the applicable withdrawal period expires.

The statutory right of withdrawal is separate from rights relating to faulty, damaged or incorrectly supplied products.

Returns & Refunds

If you exercise a statutory withdrawal right, products should be returned without undue delay and in accordance with the return instructions provided by our customer service team.

Where permitted by applicable law and where you have been properly informed before purchase, you may be responsible for the direct cost of returning goods following a change-of-mind withdrawal.

This does not apply where the return results from a defect, incorrect product or other circumstance for which STRAUMHOME is legally responsible.

You may be responsible for diminished value resulting from handling the product beyond what is reasonably necessary to establish its nature, characteristics and functionality, to the extent permitted by applicable law.

Refunds will be processed using the original payment method unless another method is expressly agreed and does not create additional cost for you.

Where permitted by law, reimbursement may be withheld until we have received the returned goods or you provide evidence that the goods have been sent back.

Made-to-Order & Customised Products

Certain products may be manufactured, configured or personalised specifically according to selections made by the customer.

Where applicable law provides an exception for products that are not prefabricated and are made according to an individual customer choice or specification, the statutory withdrawal right may not apply.

Any such restriction will be communicated where relevant before the order is completed.

Damaged, Incorrect or Defective Goods

If a product arrives damaged, is materially different from the product ordered, or is defective, please contact us as soon as reasonably possible.

Depending on the circumstances and your statutory rights, available remedies may include repair, replacement, price reduction or refund.

Where we are legally responsible for a defect, the customer will not be required to bear costs that applicable law requires us to cover.

Statutory Rights & Legal Guarantee

Consumers purchasing goods are protected by statutory rights relating to goods that are defective, not as described or otherwise fail to conform to the purchase contract.

Where German or applicable EU consumer law applies, these rights include the applicable statutory legal guarantee for consumer goods.

Any additional commercial warranty that we may offer is provided in addition to, and does not replace or restrict, mandatory statutory consumer rights.

Use of Our Website

You may use our website only for lawful personal or commercial purposes consistent with these Terms.

You must not:

  • attempt unauthorised access to our systems;
  • interfere with the operation or security of the website;
  • introduce malicious software or harmful code;
  • use automated tools to extract substantial website data without permission;
  • misrepresent your identity or impersonate another person; or
  • use the website in violation of applicable law.

Intellectual Property

The STRAUMHOME name, visual identity, photographs, graphics, product presentations, website design, written content and other materials displayed on the website are protected by applicable intellectual property laws where such rights exist.

Content may not be reproduced, distributed, commercially exploited, modified or republished without the permission of the relevant rights holder, except where permitted by law.

Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation would be prohibited by applicable law.

In particular, nothing in these Terms is intended to exclude mandatory consumer rights or liability that cannot legally be excluded.

To the extent permitted by law, we are not responsible for losses caused solely by circumstances outside our reasonable control, misuse of a product contrary to supplied instructions, or unauthorised modification of a product.

Applicable Law & Consumer Rights

These Terms shall be interpreted in accordance with the law applicable to the relevant contractual relationship.

If you are a consumer, any choice-of-law provision in these Terms does not deprive you of mandatory consumer protection that cannot legally be excluded under the law applicable to you.

Your mandatory rights concerning competent courts and consumer dispute procedures remain unaffected.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, business practices or applicable legal requirements.

The version applicable to an order will generally be the version in effect when the relevant order was placed, unless applicable law requires otherwise.

The latest version will be made available on this website together with its most recent update date.
